Terms of Service

By creating an account or using any DaGaMa service (the "Service"), you agree to these Terms. If you do not agree, do not use the Service. DaGaMa Intelligence L.L.C. ("DaGaMa", "we", "us") is a Wyoming limited liability company located at 30 N Gould St Ste N, Sheridan WY 82801.

You must be at least 16 years old and capable of entering a binding contract. The Service is intended for business use. By using it you represent that you are acting on behalf of yourself or your organisation in a commercial capacity.

• You are responsible for keeping your credentials secure.
• You must provide accurate information during registration.
• You may not share your account or allow others to access it on your behalf.
• Notify us immediately via the contact form if you suspect unauthorised access.

You may use the Service to:

• Capture and manage trade-show leads via DaGaMa bots.
• Send outreach emails through your own connected Gmail or Google Workspace account via Gaspar.
• Track business expenses via ExpenseBot.
• Source products and manage supplier relationships via SourceBot.

You must not:

• Send spam, unsolicited bulk email, or messages that violate CAN-SPAM, GDPR, or equivalent laws.
• Use the Service to harass, threaten, or defraud any person.
• Attempt to reverse-engineer, scrape, or interfere with the Service.
• Upload or transmit malware, viruses, or malicious code.
• Resell or sublicense access to the Service without written permission.
• Impersonate any person or entity.

When you connect a Gmail or Google Workspace account to Gaspar, you authorise DaGaMa to send emails on your behalf using the gmail.send OAuth scope, and (on paid plans) to read Mailer-Daemon Delivery Status Notifications via thegmail.modify scope for bounce-tracking. Bounce-tracking is required for accurate campaign reporting and automated suppression-list maintenance under the U.S. CAN-SPAM Act and equivalent international email-marketing regulations.

We do not read, modify, or delete any other email in your mailbox. The bounce-tracking process queries your inbox exclusively for messages matchingfrom:mailer-daemon or subject:"Delivery Status Notification" within the last 30 days; all other email content is out of scope and never accessed. You remain solely responsible for the content and recipients of emails sent through your connected account. You can revoke access at any time from your Google Account security settings or from your Gaspar accounts page.

Paid plans are billed via Stripe or PayPal (your choice at checkout). Prices are shown at checkout in USD. Subscriptions renew automatically unless cancelled before the renewal date. We reserve the right to change pricing with 30 days' notice. Refunds are handled case-by-case — open a request via the contact form.

DaGaMa retains all rights in the Service, including software, branding, and documentation. You retain ownership of all data you upload or generate through the Service. You grant DaGaMa a limited licence to process your data solely to provide the Service.

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be error-free or uninterrupted.

To the maximum extent permitted by law, DaGaMa's total liability to you for any claim arising from these Terms or your use of the Service shall not exceed the greater of (a) the amount you paid us in the 12 months preceding the claim or (b) USD 100. DaGaMa is not liable for indirect, incidental, special, or consequential damages.

Either party may terminate at any time. We may suspend or terminate your account immediately if you violate these Terms. Upon termination, your right to use the Service ceases. Sections 8–12 survive termination.

These Terms are governed by the laws of the State of Wyoming, USA, without regard to conflict-of-law principles. Disputes shall be resolved in the courts of Sheridan County, Wyoming, unless applicable consumer-protection law in your jurisdiction requires otherwise.

We may update these Terms at any time. Material changes will be communicated via email or an in-app notice at least 14 days before they take effect. Continued use after the effective date constitutes acceptance.
